行政案件的受理不能由资阳市中级人民法院说了算

《中华人民共和国行政诉讼法》第11条第2款、第37条第1款第38条第2款、最高人民法院《关于执行〈中华人民共和国行政诉讼法〉若干问题的解释》第32条第3款明确决定行政诉讼的受案范围。四川省人力资源和社会保障厅作出川人社复决【2013】172号、四川省教育厅作出川教复【2013】2号行政复议决定书、资阳市人民政府作出【2013】8号、【2013】12号、【2014】1号行政复议决定书，维持了相关部门的具体行政行为。当事人不服在法定期限内依据《中华人民共和国行政诉讼法》第11条第2款、第37条第1款第38条第2款的规定向雁江区人民法院提出行政诉讼，雁江区人民法院对当事人的起诉没有既不裁定不予受理、又不受理立案。为此依据《中华人民共和国行政诉讼法》第11条第2款、第37条第1款、第38条第2款，最高人民法院《关于执行〈中华人民共和国行政诉讼法〉若干问题的解释》第32条第3款的规定向资阳市中级人民法院提出行政诉讼。时至今日资阳市中级人民法院法院对当事人的起诉没有既不裁定不予受理、又不受理立案。当事人强烈要求资阳市中级人民法院将《最高人民法院关于依法保护行政诉讼当事人诉权的意见》、《最高人民法院关于深入整治“六难三案”问题加强司法为民公正司法的通知》落实到位；行政案件的受理不能由资阳市中级人民法院说了算！
